Deepfake and Synthetic Media Screening

A deepfake allegation should be handled with discipline, not theatrics. Screening can help identify risk, but the legal question still depends on source files, provenance, metadata, platform history, corroborating records, and clear limits.

Screening Is a Triage Function

Synthetic-media screening is not the same as a final authentication opinion. It is an early disciplined review designed to determine whether a disputed image, video, or audio file presents technical indicators that justify deeper examination, additional source-data requests, or expert reporting. The work helps counsel decide whether the authenticity issue is grounded enough to raise and what records are needed to test it.

That distinction matters. A party can misuse a screening result by treating it as proof. A party can also misuse modern AI anxiety by claiming every unfavorable recording is fake. The examiner's job is to separate grounded concern from unsupported suspicion.

Start with the Source, Not the Suspicion

A short clip, compressed image, or downloaded audio file may be several steps removed from the original recording environment. Before any detection result is meaningful, counsel should ask for the native file, device or platform source, export history, account context, longer recording, surrounding files, and chain-of-custody records. Without those materials, the examiner may be able to identify risk but not reach a reliable conclusion.

Provenance is often more valuable than surface appearance. A file that looks unusual may be explainable by compression, platform processing, editing software, screen recording, or surveillance export. A file that looks smooth may still lack a credible origin story. Screening therefore looks at both the file and the path by which it reached the legal record.

Detector Output Must Be Treated Carefully

Automated deepfake or synthetic-media tools may examine visual artifacts, facial consistency, audio features, compression patterns, or statistical signals. Those tools can assist triage, but they are not universal truth machines. Performance may change with file quality, compression, resolution, editing, platform processing, language, recording conditions, and the type of synthesis used.

NIST's work on evaluating analytic systems against AI-generated deepfakes is important because it frames detection as an operational evaluation problem. For litigation, that means counsel should ask what tool was used, what it was designed to detect, what material was submitted, what limitations apply, and whether the result is consistent with independent forensic indicators.

What Screening Looks For

  • Missing or inconsistent source history for the file offered as evidence.
  • Metadata, encoding, duration, frame, stream, or file-structure details that do not fit the claimed origin.
  • Signs of export, recompression, clipping, screen recording, or platform processing that affect interpretation.
  • Audio, visual, or temporal irregularities that justify deeper review.
  • Mismatch between the exhibit and surrounding device, account, cloud, message, or recording-session records.
  • Automated detector results, if used, considered alongside provenance and technical context.

Authentic Evidence Can Be Harmed by Loose Deepfake Claims

A vague accusation that a recording is a deepfake can be as damaging as a fabricated exhibit. It can distract from the actual record, delay resolution, and create doubt where the technical evidence does not support doubt. A serious screening process protects both sides of the problem: it helps expose false media when the evidence supports that concern, and it helps defend authentic media against speculation.

The report should therefore state not only what was suspicious, but also what was not. If the available file is consistent with ordinary export processing, say so. If no synthetic-media indicators were found but the native file is missing, say both things. If a detector result is inconclusive, the report should not turn it into a stronger conclusion than the data supports.

Screening can support early case assessment, emergency preservation requests, subpoenas or discovery demands for native files, deposition preparation, expert consultation, and decisions about whether to raise an authenticity challenge. It can also identify when the better challenge is not synthetic media but clipping, context, export quality, or missing provenance.
