The Tool Is Not the Starting Point
Law firms often begin AI planning by asking which tool to use. That is the wrong first question. The better first questions are legal and operational: what client data will be handled, what privilege or confidentiality issues exist, what evidence must be preserved, who may access the system, what outputs will be relied on, and how human review will be documented.
AI workflow design for lawyers should begin with the duties of competence, confidentiality, supervision, communication, and candor. The technology has to fit the obligation, not the other way around.
Client Data Boundaries Need to Be Explicit
A firm should know what data may be placed into an AI system before the first document is uploaded. Client files, discovery productions, medical records, financial records, device extractions, privileged communications, sealed materials, protective-order material, and personally identifiable information may each require different controls.

Native files, metadata, extraction packages, productions, and chain-of-custody records should be preserved separately from AI-generated notes, summaries, embeddings, or issue tags.
This distinction protects the case. If a summary is wrong, the source record remains intact. If a model groups documents incorrectly, the production can still be reviewed. If a court asks where an exhibit came from, the answer should not depend on a black-box workspace with unclear logs.
Controls That Belong in the Workflow
- Matter-specific rules for what data can and cannot be processed through AI tools.
- Vendor review focused on retention, training, logging, access, security, jurisdiction, and deletion.
- Role-based access so client data is not exposed to unnecessary users or workspaces.
- Human review of outputs before they affect legal advice, filings, discovery, or client communications.
- Source citations for any AI-assisted summary, chronology, issue list, or document analysis.
- Separate storage for native evidence, work product, prompts, outputs, and final attorney-reviewed material.
The Output Needs a Status Label
Not every AI output has the same legal status. A rough internal triage note is different from a client memorandum. A search expansion is different from a factual finding. A draft deposition outline is different from a court-facing declaration. The workflow should mark what the output is, who reviewed it, whether it is source-cited, and whether it is ready for reliance.
That discipline prevents a common failure: an early model-generated summary hardens into case truth before anyone verifies it. Legal teams should be able to see which outputs are unreviewed, reviewed, corrected, approved, or rejected.
